Genesis eBONDS End User License Agreement (EULA)

Effective Date: December 11, 2024

This End User License Agreement (“Agreement”) constitutes a legally binding agreement between you (“End User”) and GenCore Candeo, Ltd., dba The Genesis Group (“Genesis”). By accessing or using the genesisebonds.com platform (“Platform”), you agree to be bound by the terms of this Agreement. If you do not agree to these terms, you must not access or use the Platform.


1. Grant of License

Genesis grants the End User a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform strictly for its intended purpose: facilitating secure, web-based bail bond processing in accordance with applicable policies of authorized users and jurisdictions.


2. Restrictions on Use

End Users shall not:

  • Use the Platform for any unlawful or unauthorized purposes.
  • Share access credentials with unauthorized parties.
  • Reverse engineer, decompile, or disassemble the software or attempt to derive its source code.
  • Circumvent, disable, or tamper with any security features of the Platform.
  • Upload malicious code, viruses, or engage in any activities that disrupt or impair the functionality of the Platform.


3. Pricing and Payment

Access to the Platform may be subject to fees, depending on the End User’s specific agreement with Genesis. While certain users may access the Platform without cost, others may incur transaction-based fees or other charges. The applicable pricing and payment terms are governed by the individual or organizational agreement between the End User and Genesis.


4. Data Ownership and Processing

All data processed through the Platform remains the property of the respective user or organization. Genesis acts as a data processor, ensuring that all data is encrypted and secure. Upon termination of access, data deletion requests can be submitted, but such requests may incur professional service fees.


5. Authorized Access

Access to the Platform is restricted to authorized users with valid credentials. Sharing login credentials or permitting unauthorized access is strictly prohibited and may result in immediate suspension or termination of access.


6. Support and Maintenance

Genesis will provide support services to address issues related to the accuracy and functional usability of the Platform. Support is available 24/7/365 to authorized users. While Genesis strives to ensure uninterrupted operation of the Platform, it does not warrant uninterrupted service and will make commercially reasonable efforts to resolve issues promptly.


7. Limitation of Liability

To the maximum extent permitted by law, Genesis shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform, including but not limited to service interruptions, data loss, or inaccuracies.


8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, excluding its conflict of laws principles. In cases where a separate Service Agreement exists between the parties, the governing law provisions of that Service Agreement shall prevail in the event of a conflict.


9. Termination

Genesis reserves the right to terminate this Agreement and revoke access to the Platform if the End User violates any of the terms or engages in misuse of the Platform.


10. General Provisions

  • Force Majeure: Genesis shall not be held liable for delays or failures caused by events beyond its reasonable control, including but not limited to natural disasters, acts of government, or technical failures.
  • Amendments: Genesis reserves the right to modify this Agreement at any time. Continued use of the Platform following such modifications constitutes acceptance of the updated terms.


11. Acknowledgment

By accessing or using the genesisebonds.com Platform, you acknowledge that you have read, understood, and agreed to the terms and conditions of this Agreement.

Genesis eBONDS Platform Privacy Policy

Effective Date: December 11, 2024

This Platform Privacy Policy (“Privacy Policy”) describes how GenCore Candeo, Ltd., dba The Genesis Group (“Genesis,” “we,” “us,” or “our”) collects, uses, processes, and protects information when users access and use the eBONDS™ platform available at genesisebonds.com (the “Platform”).

This Privacy Policy applies only to the eBONDS Platform and does not govern information collected through marketing websites, newsletters, or other non-Platform interactions, which are covered under separate privacy statements.

By accessing or using the Platform, you acknowledge and agree to the practices described in this Privacy Policy.


1. Roles and Responsibilities

Genesis acts as a data processor with respect to information processed through the Platform. Authorized agencies, bonding entities, courts, and other institutional customers (“Customers”) act as the data controllers and determine:

  • What data is submitted to the Platform
  • The legal basis for processing
  • Retention requirements
  • Authorized access

Genesis processes data solely on documented instructions from Customers and in accordance with applicable U.S. laws.


2. Information We Process

Depending on Customer configuration and authorized use, the Platform may process the following categories of information:

a. User Account Information

  • Name
  • Email address
  • Role or title
  • Authentication credentials (securely stored)
  • Bond license numbers
  • Employer/agency affiliation

b. Defendant / Inmate Information

  • Name
  • Date of birth
  • Identifying information (such as height, weight, etc.)
  • Home address
  • Partial SSN
  • State license information
  • Identifying reference numbers
  • Custody or booking status
  • Court or jurisdictional information

c. Transaction and Bond Information

  • Bond amounts and conditions
  • Case references
  • Status updates
  • Related documents

d. Technical and Security Information

  • IP addresses
  • Device and browser metadata
  • Platform access logs
  • Audit and activity records

Genesis does not independently determine the content or accuracy of data submitted by Customers.


3. Purpose of Processing

Genesis processes Platform data solely for the following purposes:

  • Facilitating secure, web-based bail and bond processing
  • Authenticating authorized users
  • Maintaining audit trails and system integrity
  • Providing customer support and troubleshooting
  • Complying with lawful requests, court orders, or legal obligations
  • Protecting the security and availability of the Platform

Genesis does not use Platform data for advertising, data mining, or profiling.


4. Data Sharing and Disclosure

Genesis does not sell or rent Platform data. Data may be disclosed only to:

  • Customers and their authorized users;
  • Infrastructure, hosting, and security service providers operating under confidentiality obligations;
  • Payment processors, when applicable;
  • Government authorities or courts pursuant to lawful orders, subpoenas, or statutory requirements.
  • Genesis eBONDS acts solely as a platform provider. Data may be made available to third party systems connected by a Customer using customer-issued API credentials. Access is controlled by the Customer, though Genesis eBONDS may manage API keys at the Customer’s direction. Customers are responsible for the handling of data shared through the platform, and Genesis eBONDS does not control how connected third parties handle accessed data.


5. Data Retention and Deletion

Platform data is retained in accordance with:

  • Customer instructions and contractual agreements;
  • Applicable laws and regulatory obligations;
  • Legitimate business and security requirements.

Upon termination of Platform access, Customers may request data deletion, subject to:

  • Legal holds
  • Backup retention cycles
  • Regulatory or court-mandated preservation requirements

Professional service fees may apply for customized data extraction or deletion requests.


6. Data Security

Genesis implements administrative, technical, and physical safeguards designed to protect Platform data, including:

  • Encryption of data in transit and at rest;
  • Role-based access controls;
  • Multi-factor authentication where available;
  • Monitoring, logging, and intrusion detection;
  • Regular security reviews and updates.

No system is completely secure; however, Genesis maintains commercially reasonable safeguards appropriate to the sensitivity of the data processed.


7. User Responsibilities

Authorized users are responsible for:

  • Maintaining the confidentiality of login credentials;
  • Accessing the Platform only for authorized and lawful purposes;
  • Ensuring compliance with applicable federal, state, and local laws;
  • Promptly notifying Genesis of suspected unauthorized access or misuse.

Genesis does not monitor or validate the legal compliance of user decisions made using the Platform.


8. State Privacy Rights

Genesis complies with applicable U.S. state privacy laws, including but not limited to those providing rights related to access, correction, or deletion of personal information.

Because Genesis acts as a data processor, requests related to personal data rights should be directed to the applicable Customer or agency serving as data controller. Genesis will reasonably assist Customers in responding to such requests as required by law.


9. Children’s Information

The Platform is not intended for use by individuals under the age of 18. Genesis does not knowingly collect information directly from minors.


10. Changes to This Privacy Policy

Genesis may update this Privacy Policy from time to time. Material changes will be reflected by an updated effective date. Continued use of the Platform after such updates constitutes acceptance of the revised Privacy Policy.
